Application Terms of Service
Last updated: 20 October 2026
These Terms of Service govern access to and use of the Nebraska AI Health platform, patient portal, websites and mobile applications (together, the 'Service') operated by Nebraska Al Emarat ('Nebraska', 'we', 'us'). By creating an account, using the Service, or accessing it through an organization invitation, you agree to these Terms on behalf of yourself and, where you accept on behalf of an organization, your organization.
1. The Service and professional use
The Service is provided to healthcare and pharmaceutical organizations and their authorized staff for clinical, research and operational purposes. It is intended for use by qualified professionals.
AI-generated content (treatment plan drafts, prescribing checks, imaging screenings, research dossiers and similar outputs) is decision support only. It is not a medical device, does not constitute medical advice, and must be reviewed and approved by a qualified clinician before any clinical decision is made. The treating clinician and the organization remain fully responsible for all clinical decisions and actions taken in connection with the Service.
The patient portal lets patients sign consents and report outcomes at the invitation of their treating organization. It does not provide treatment, diagnosis or emergency services. In an emergency, patients must call local emergency services, not use the Service.
2. Eligibility and accounts
- •You must be at least 18 years old and authorized to act for a licensed healthcare or research organization.
- •Each user must keep credentials confidential, use only their own account, and use multi-factor or strong authentication where offered.
- •Organizations are responsible for the acts and omissions of their users, for removing access promptly when staff leave, and for the accuracy of the data they enter.
- •Access for new organizations becomes active only after platform approval of the organization, and may be suspended for violation of these Terms.
3. Acceptable use
- •Do not upload data the organization is not lawfully permitted to process, or process patient data without a lawful basis, authorization or valid consent.
- •Do not attempt to access another organization’s data, interfere with the Service, probe or scan its infrastructure, or reverse engineer it except as permitted by applicable law.
- •Do not use the Service to store unlawful content or to infringe third-party intellectual property or patient rights.
- •Do not disable, bypass or misrepresent clinical safety features, alerts, e-signatures or the audit chain.
4. Intellectual property and platform attribution
- •Your organization retains all rights to the clinical and research data it enters, including patient records.
- •Nebraska and its licensors retain all rights in the platform, software, models and interfaces.
- •Research, manufacturing and testing content generated through the platform (including dossiers intended for patent, publication or regulatory filing) must retain attribution to the platform and carry the accompanying disclaimer identifying the work as AI-assisted and attributing intellectual property support to Nebraska AI Health (MedNova) / Cognexia AI Tech.
- •You may not remove, obscure or alter any such attribution, safety disclaimer or legal notice.
5. Availability, support and changes
- •We aim for high availability but do not guarantee uninterrupted service; maintenance windows and incidents are communicated within the app.
- •We may add, change or discontinue features; material reductions in core functionality of a paid plan will be announced in advance.
- •Support is provided through the channels and service levels described in your agreement.
6. Disclaimers and limitation of liability
The Service is provided ‘as is’ and ‘as available’ without warranties of any kind except those that cannot be excluded by law. Without limitation, we do not warrant that outputs are error-free, complete or fit for a particular clinical purpose.
To the maximum extent permitted by applicable law, neither Nebraska nor its group companies are liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill. Our aggregate liability for claims arising out of or relating to the Service is limited to the fees your organization paid to us in the twelve months preceding the event, except where a higher liability is mandated by law (for example for gross negligence, willful misconduct or breaches of data protection law that cannot be limited).
Nothing in these Terms limits either party’s obligations under applicable healthcare, data protection or consumer protection law.
7. Indemnification
You will defend and indemnify Nebraska against third-party claims arising from your organization’s data, your use of the Service in violation of these Terms or applicable law, including any claim that patient data was processed without a lawful basis or valid consent.
8. Termination
- •You may stop using the Service at any time; organizations may close their account per the agreed notice period.
- •We may suspend or terminate access for material breach, unlawful use, or non-payment, with notice where practicable.
- •On termination, your organization may export its data during the agreed period, after which data is deleted or anonymized as described in the Privacy Policy, subject to legally required retention of medical records.
9. Governing law and disputes
These Terms are governed by the applicable laws of the United Arab Emirates. The parties will first attempt to resolve disputes amicably; unresolved disputes are subject to the exclusive jurisdiction of the competent courts of Dubai, UAE, without prejudice to mandatory consumer rights or the jurisdiction of data protection authorities.
10. Privacy
Our handling of personal and health information, including patient rights and security measures, is described in the Application Privacy Policy, which forms part of these Terms.
11. Changes and contact
We may update these Terms; material changes are announced in the app before they take effect, and continued use after the effective date constitutes acceptance.
